I thought the same thing - but I emailed Micheal Geist asking about a take down notice I received and his said there were copyright laws [or some laws] that could be used to have the files removed regardless - can't find the email right now with his explanation but it didn't matter if it was DMCA notice. You could delay them getting their way but they had a means to get it. Sorry I can not offer more at the moment.......And if you ignore them and have a US server they just go after the hosting company anyways to remove it - which is what they did to me.

I will note that in my case I was hosting music I clearly had no rights to and his comments were directed at that fact.

Ok so i am a little confused here, and maybe someone could help me out.

A few music blogs i frequent are places where independent artists submit songs they have produced and then the cream of the crop is then made available to the public. There are also album promos, videos, sample sets for remix competitions and so forth. These site have also been targeted by this bullshit copyright law, and had entire archives, and content removed. This content was supplied by the artist or by the record label and is solely their property to do with as they wish, so how is it possible for some third party to come and say " No thats copyright infringement, we are removing that."

I understand the need to protect intellectual property in lots of cases, but this just seems like the larger music labels have scared enough people into not even questioning them any more and they are making the rules. Can someone tell me how this is possible?

Its huge vertically integrated entertainment companies with bloated legal budgets that throw their weight around intimidating anyone and everyone who they might consider competition and/or easy scape goats (like servers and independant companies) with blanket threats and long, over stuffed 'infrigment' lists. Its not done on a case by case basis most of the time its done on a "hey here's one minor example lets over blow it and take the entire thing down" type of mentality. Unfortunatly some cave from the pressure and perfectly innocent media owners get included in the shake up.

In other cases it's a matter of large web sites like Blogger who are owned by google playing the corporate media game at the expense of their users. In other words blogger is doing the IFPI's dirty work.

at least thats my take on it
